Fair Use Policy
This Fair Use Policy ("Policy") governs your use of deverus services, including Workflow AS, Verocity 2.0, the deverus website, and any related APIs or integrations (collectively, the "Services"). By using the Services, you agree to comply with this Policy.
1. Permitted Use
The Services are licensed for use by Consumer Reporting Agencies (CRAs), background screening companies, and authorized end users to coordinate, automate, and execute screening-related operational workflows in accordance with the Master Services Agreement (MSA) and applicable law, including the Fair Credit Reporting Act (FCRA) and equivalent state and local laws.
2. Prohibited Activities
- Using the Services in violation of any law, regulation, or contractual obligation, including the FCRA, GLBA, DPPA, and applicable state privacy laws.
- Reverse engineering, decompiling, or attempting to derive source code or trade secrets from the Services, except as expressly permitted by law.
- Probing, scanning, or testing the vulnerability of any deverus system without prior written consent.
- Interfering with or disrupting the integrity or performance of the Services or the data contained therein.
- Using the Services to send unsolicited bulk communications, malware, or any harmful code.
- Misrepresenting your identity, your authority to access information, or the source of any data submitted.
- Using the Services to harass, defame, or discriminate against any individual.
3. Reasonable Use Thresholds
- The Services are provided with capacity expectations consistent with normal CRA operational use. "Normal" use is determined by reference to the role count, automation tier, and order volume contemplated in your order form or active subscription.
- Excessive API calls, queue depth, or storage consumption that materially exceed normal use may trigger throttling, additional fees, or a request to upgrade to a higher tier.
- deverus will provide reasonable notice before enforcing throttling or assessing overage fees, except in cases of system risk or active abuse.
4. Customer Responsibilities
- You are responsible for the accuracy and lawful sourcing of all data you submit, including consumer consent, dispute handling, and adverse action workflows required by the FCRA.
- You are responsible for safeguarding user credentials, role-based access controls, and any session tokens issued to your team.
- You are responsible for reviewing automated outputs proposed by the Services. Under our Human-in-the-Loop model, automation proposes and humans judge — you remain accountable for final consumer report outputs.
5. Suspension and Termination
deverus may suspend or terminate access to the Services for material violations of this Policy, with notice and an opportunity to cure where commercially reasonable. We may suspend immediately, without prior notice, for activity that poses a security, legal, or operational risk to deverus, our customers, or third parties.
6. Reporting Abuse
Report suspected violations of this Policy to abuse@deverus.com. Please include relevant details such as the affected workflow, account, time of activity, and any supporting evidence.
7. Updates
deverus may update this Policy from time to time. Continued use of the Services after a posted update constitutes acceptance of the revised Policy.
